PRIVACY POLICY

CUCKOO Electronics America Inc. has created this Website Privacy Policy (the “Privacy Policy”) to demonstrate our firm commitment to your privacy rights. This Policy explains the kind of data we collect from our website and the purposes for which we use and disclose the data. This Policy also describes how the data is protected and actions you may take if you have concerns about your privacy rights.

GENERAL STATEMENT OF PRINCIPLES

We may gather data from you on this website so that we can improve the delivery of our services and products. Sometimes the data we collect relates to you or identifies you. Data containing information about an identifiable individual is defined as “personal information.”

Our goal is always to maintain the highest levels of privacy and security with your personal information, in keeping with the principles of the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”) and applicable local privacy laws in Canada. We will only process your personal information under lawful circumstances and will not sell your personal information to other third parties. Generally, we will only collect your personal information if you have provided consent.

There are three basic categories of personal information we collect:

  • Personal information you provide to us directly.
  • Personal information we collect when you use our services.
  • Personal information we collect from third parties.

By using our website, you consent to our collection and handling of your personal information in accordance with this Privacy Policy. Your consent can be withdrawn as further described below.

PERSONAL INFORMATION YOU PROVIDE TO US DIRECTLY

When you interact with our services, we collect personal information that you provide to us. For example, many of our services require you to set up an account, and we may need to collect a few important details about you, such as your name, username, password, email address, phone number, and mailing address. If you make a purchase, we may require you to provide us with a debit or credit card number and its associated account information. When you contact customer support or communicate with us in any other way, we will collect whatever information you volunteer or that we need to resolve your question. That may include certain information about gift recipients identified by you.

PERSONAL INFORMATION WE COLLECT WHEN YOU USE OUR SERVICES

Sometimes the reason for our collection of your personal information will be obvious (such as when you give us your email address to allow us to contact you). If it is not, we will describe to you at the time of collection the purpose of collecting the personal information and, if required by law, ask for your consent.

We may also collect the following personal information:

  • Records of your visits to the site, through cookies and otherwise (which records may include traffic data, location information, information about your computer or mobile device such as if applicable your IP address, operating system, mobile carrier, or device information).
  • Records of correspondence between us and you.
  • Comments, posts, or other personal information you upload to our site.
  • Information you provide by completing forms on our website or in our products and services.

In general, we do not intentionally collect sensitive personal information. Sensitive personal information can include your social security number, information concerning racial or ethnic origin, political opinions, membership in trade unions or professional or trade associations, physical or mental health information, biometric data, genetic data, personal information concerning sexual activity or orientation, or personal information concerning criminal records or suspected criminal activity.

We do not intentionally collect personal information from anyone under the age of majority. By using our website, products, or services, and by submitting any personal information to us, you warrant that you have reached the age of majority in your province or territory.

PERSONAL INFORMATION WE GET FROM THIRD PARTIES

We may collect personal information about you from other users, our affiliates and third parties. For example, with consent, advertising companies, app developers, publishers, and other third parties may share your personal information with us. We may use this personal information, among other ways, to help target or measure the performance of ads.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the personal information we collect from you to provide information, services, or products you have requested or purchased, and to allow you to interact with us and the website. This may include sending you emails from time to time. These emails always contain either information you have requested and that you have consented to receive, or information we have a legitimate interest in receiving (such as notices of product changes) as permitted by Canada’s Anti-Spam Legislation (CASL). You can always unsubscribe from any email list by clicking the indicated link in the email.

We may also use your personal information in the following ways:

  • To personalize your experience at our website and to allow us to deliver the type of content and product offerings that may interest you.
  • To allow us to better serve you by responding to your customer service requests.
  • To quickly process your transactions.
  • To administer a contest, promotion, survey or other site features.

If you have opted-in to receive our e-mail newsletter, we may send you periodic e-mails. If you have not opted in to receive e-mail newsletters, you will not receive these e-mails. Visitors who register or participate in other site features such as marketing programs and ‘members-only’ content will be given a choice whether they would like to be on our e-mail list and receive e-mail communications from us.

We collect personal information from you, including texting preferences such as opt-ins and opt-outs, and may request your consent to receive SMS (text message) notifications or alerts through an online form or other means. If you choose to opt-in or subscribe to receive SMS notifications, you agree to receive messages from us about flash sales, promotions, cart reminders, and other updates. The frequency and content of these messages may vary. By consenting, you acknowledge that message and data rates may apply based on your mobile carrier’s terms, and you should contact your carrier with any rate-related questions. You can unsubscribe from receiving SMS notifications at any time by replying “STOP” via SMS or contacting us at info@cuckooamerica.com.

Your SMS opt-in and related personal information will not be shared with third parties for purposes unrelated to our campaigns. However, we may share your personal information, including your consent status, with third-party service providers who assist us in delivering these messages, such as platform providers, phone carriers, or other vendors essential to the messaging process.

HOW DO WE USE “COOKIES”?

Our website uses cookies to improve your experience while you’re with us, for traffic analytics, and advertising. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information.

For instance, we use cookies to help us remember and process the items in your shopping cart. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected by us except to help us conduct and improve our business.

You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (e.g. Google Chrome or Internet Explorer) settings. Please refer to your browser Help menu to learn the correct way to modify your cookies.
